What the contract says

We read six prop firm contracts: all six make the fee non-refundable, and only one puts you in a live market

Not the marketing pages, the actual terms and conditions of Super Funded, Clarity Traders, TradeDay, FundedNext, Top One Futures and Funded Futures Family. Two of the six never name a governing law.

Prop firm comparisons rank on profit split, drawdown and price, because those are the numbers on the sales page. We read the contracts instead. Six of them, in full, over the last week.

The documents agree on more than the marketing does, and they disagree in places the marketing never mentions.

Six firms, six different companies, five jurisdictions. Not one of them is the brand name you searched for, and four of the six put that name nowhere on the sales page.

The fee is non-refundable at all six

This is the only thing every contract agrees on, and it is unanimous without a single exception.

Two carve-outs exist and both are narrow. Super Funded refunds if it declines to open your account, or if you pay and never start. Nobody refunds a failed evaluation, and nobody refunds a change of mind.

That matters because Clarity Traders prices every plan on its sales page under the heading “Refundable Fee”. The word appears three times on the page that takes the payment, and the contract on the same domain says the opposite in capitals.

Only one of the six trades in a live market

TradeDay’s definitions:

Funded LIVE Account means a futures or options account trading account of the User funded by TradeDay.

Four of six never place an order in a real market at any stage. That is a legitimate product and it is not the product the word "funded" suggests.

At a firm whose funded stage is simulated, a payout comes out of the firm’s own revenue, because there is no position anywhere generating it. At TradeDay there is a real account behind the number. Neither arrangement guarantees you get paid; they are different businesses wearing the same word.

Every contract can take the money back

All six reserve the right to withhold or forfeit a payout. Two go further and allow recovery of money already in your hands.

Super Funded, clause 24.3: where it ends participation for breach, it “may take steps to recover sum(s) paid to you while you are (or were) in breach”.

Funded Futures Family: “all Benefits you previously received are conditional and subject to clawback and forfeiture” if a prohibited dispute is initiated or a material breach occurs.

Disputing a charge is itself a breach at three of them. Clarity Traders treats any chargeback as “a material breach” carrying forfeiture and permanent restriction; Super Funded makes you liable for its costs “on a full indemnity basis” for an unsubstantiated chargeback; FundedNext may “withhold, suspend, or offset any pending or future Performance Rewards against the value of the disputed amount”.

So the payment method’s own protection is contracted away in the same document that makes the fee non-refundable. Those two clauses work together, and they are worth reading as a pair.

Payout is discretionary everywhere it is addressed

Super Funded is the most explicit document we read, and the clearest sentence in the whole set is its clause 13.5:

There is no correlation between payment of an Access Fee and eligibility to receive a Payout.

Funded Futures Family funds graduates “pursuant to Funded Futures Family’s sole discretion”. Clarity Traders calls profit sharing “a contractual reward, not an entitlement or investment return”, subject to discretionary review.

Two contracts do not address payouts at all. TradeDay’s funded-account terms are a separate agreement that is not published, so the profit split, schedule and withdrawal conditions sit outside what a buyer can read before paying. FundedNext’s futures challenge terms cover the challenge and not the reward.

Two of six never name a governing law

This is the finding we did not expect, and it is the one that decides what any of the above is worth.

Only two of six tell you where a dispute would be heard. Top One Futures names no state or country, only “applicable local laws”, which is a phrase and not a jurisdiction. Funded Futures Family’s terms contain neither.

For a US buyer, TradeDay’s arrangement is the reachable one: Illinois law, arbitration in Chicago. Super Funded’s is real but expensive, since an LCIA arbitration under Seychelles law costs more than any evaluation fee by a wide margin, which in practice means the forum exists and will not be used.

One firm’s money goes somewhere else entirely

FundedNext’s futures terms name GrowthNext-F.Z.E., business registration 28831, in Ajman. Payment processing is handled by a different company: Incenteco Trading LTD, HE 307114, and that HE prefix is a Cyprus registration.

So the entity you contract with and the entity that receives your card payment are in different countries. That is not unusual for online businesses and it is not an allegation. It does mean a chargeback, a refund request and a legal claim would each land somewhere different, which is worth knowing before rather than after.

What to do with this

Find the entity before you pay. It is in the terms, not on the sales page, and at four of these six it appears nowhere else. Our page on checking a broker on the regulator’s register sets out why the brand and the company are routinely different.

Read the payout clause, not the profit split. The split is a percentage of something the contract does not promise you will receive.

Check whether the funded stage is live. One word in the definitions section answers it, and four of six answer it the way the marketing does not suggest.

Assume the fee is gone. All six say so, and the two carve-outs we found cover only the case where you never start.

What we checked, and what we didn’t

We read the full terms and conditions of all six firms between 25 August and 1 September 2026, and every quotation above is from those documents. Where a document is silent we have written that it is silent rather than inferring.

We have not bought an evaluation at any of these firms, traded one, requested a payout, or been refused one. This page reports what the contracts say, which is a different question from how the firms behave, and the second question is not one a document can answer.
